Cleveland fires 1 officer, suspends 2nd in Tamir Rice shooting

In 2015, a grand jury decided not to bring charges against Timothy Loehmann and Frank Garmback for the death of Tamir Rice, a 12-year-old boy who was shot by Loehmann in a Cleveland playground while holding a toy gun. The officers were called to the scene on a report of a person waving a gun.

A message was left with the police union about the discipline. In a surveillance video released shortly after Tamir Rice's death, it was revealed that Loehmann had fired at him within two seconds of stopping the patrol vehicle.

Frank Garmback, a second officer involved in the shooting, will be suspended for 10 days for improper tactics and receive additional tactical training, McGrath said. McGrath also admonished Garmback for not waiting for another vehicle, as is standard practice on a gun call.

The announcement was the result of a review by the department's critical incident review committee, Williams said. They claim that the only rule violated by the officers in the Rice shooting was not notifying communications of their position in the moments prior to the shooting itself.

At the time, Cuyahoga county prosecutor Timothy McGinty described the tragedy as a "perfect storm of human error, mistakes and miscommunications".

Samaria Rice settled a federal civil rights lawsuit with the city a year ago for $6 million. Someone called the police, mentioning in the process that the gun could be fake.

"Soon afterward, police drove onto the grass within feet of 12-year-old Tamir". He later claimed Rice had reached for his waistband. Loehmann's firing was effective Tuesday.

Rice suffered two gunshot wounds and died the next day.

An internal affairs investigation would later conclude that he did not violate any department policies when he shot and killed Tamir.

"You know, it's hard when a child - in this case, a 12-year-old - loses their life", he said.

Cleveland city officials on Tuesday moved to discipline the officers.
