In spite of tweet, lawyer says Trump not under investigation

Donald Trump isn't under investigation by special counsel Robert Mueller, a member of the president's legal team said, despite Trump's repeated comments that he's the target of a "witch hunt".

It was unclear whether his tweet about being under investigation was based on direct knowledge or new media reports that suggest Mueller is examining whether the president obstructed justice by firing Comey. Sekulow admitted not knowing whether Trump was under investigation, saying he had not heard about an investigation and said it was unfair for him to be questioned about speculation.

But Jay Sekulow, part of Trump s legal team, said the president was writing about reports of an investigation, not an actual probe. "The president is not under investigation".

He returned to Washington Sunday amid new questions about the Russian Federation investigation.

"I don't believe it's going to happen", said Rubio on CNN's "State of the Union".

Trump tweeted on Friday: "I am being investigated for firing the FBI Director by the man who told me to fire the FBI Director!" Sekulow said that Trump, in his tweet, was reacting to a story in the Washington Post, which was the first to report that Mueller was examining whether Trump had tried to obstruct the probe by firing Federal Bureau of Investigation director James Comey in May. "He can not in a Twitter statement include all of that in there, but "The Washington Post" statement came out that morning", he said. "We're a nation of laws that apply equally to everyone, a lesson the president would be wise to learn", she said.

But Sekulow said repeatedly Sunday that "the president has not been and is not under investigation".

"So the president responds - I want to be crystal clear here". Mueller was tasked with taking over the executive branch's investigation into alleged Russian interference and potential collusion between Russia and Trump's associates.

Suggestions that Mueller is looking at Trump's actions grew last week when Mueller requested interviews with three high-ranking current or former intelligence officials, according to a person briefed on the investigation.

Sekulow pointed to testimony Comey gave to the Senate Intelligence Committee, in which he declared that there was no investigation of Trump under way when he was sacked.

He maintained that the president is not being investigated for obstruction of justice in an exchange with host Chris Wallace because they have not received a notice of investigation.

They said previous presidents would make sure to have the White House counsel's office and their personal lawyers carefully review any comments about such an investigation before making them. In fact, it may be that the odds of removal are greater if Mueller and his team of left-leaning partisans stay on and devote endless resources to conjuring up a case against the president. "If Mueller thinks there is evidence that obstruction occurred, Mueller's job is to investigate".

Again, Sekulow left out some key points, which Wallace and others were only too happy to raise: Trump later told NBC's Lester Holt that he had already made up his mind to fire Comey regardless of the recommendation from Sessions and that he was firing him because he was unhappy with the Russian Federation investigation.

A source familiar with the matter told CNN's Evan Perez that investigators for Mueller would speak with Director of National Intelligence Dan Coats and National Security Agency Director Mike Rogers.
