The couple withdrew the proceeding from the New York court where it was being heard, the New York Post reported Wednesday.

But a family law expert said Abedin and Weiner would still have to file for divorce in court if they want their settlement to be legally binding.

Abedin finally filed for the split last May just hours after Weiner pleaded guilty to sexting with a minor. The couple could re-file their divorce as "uncontested", meaning they would not have to appear in court.

Abedin's lawyer issued a statement about the decision, noting the two will settle the divorce privately.

Weiner, a Democrat, resigned his U.S. House seat in 2011 amid a sexting controversy involving women, only to have new allegations doom his 2013 run for NY mayor.

Weiner, a disfavored government official once thought about a main Democratic figure, is right now serving a 21-month sentence in MA for sending lascivious photos to a minor. Abedin became ensnared in the Clinton email probe. Clinton has called Comey's intervention "the determining factor" in her defeat.
