Pizza Delivery Man Facing US Deportation Order Granted Stay

NY - A federal judge on Saturday temporarily blocked the deportation of a NY pizza shop worker to his native Ecuador after he was arrested while making a delivery to a Brooklyn Army base.

"ICE may feel confident in its legal position, but our client's confidence in the judiciary, as well as the will of the American people, is stronger", said Jennifer Williams, an attorney with the Legal Aid Society, which is representing Villavicencio.

"The enforcement mechanism that was applied in Pablo's case is inhumane, unjustifiable and should shock the conscience", she said. "This is the deportation machine in full effect".

Cuomo said that Villavicencio has been a resident of New York City for over 10 years, and that "he is a working father, a taxpayer, and the primary provider for his US citizen wife and two daughters, one of whom suffers from a serious medical condition".

"What prompted them to call ICE?" she asked. He's the center of our family. "We ask Governor [Andrew] Cuomo to give access to a driver's license to all others so they don't have to suffer this situation". "Our family calls on the government to do the right thing and stop dividing families like my family".

Pablo Villavicencio was detained while delivering a pizza June 1.

A statement issued by Fort Hamilton last Friday said Villavicencio attempted to make a delivery about 11 a.m. but lacked identification required to enter.

An active ICE warrant for Villavicencio was on file because he had not complied with an immigration judge's voluntary departure order in 2010.

When he failed to produce the required documents, the soldier detained him and called Immigration and Customs Enforcement (ICE), which established that the father of two girls, aged two and three, had been living illegally in the country since 2010.

"Although we are disappointed that Pablo will remained detained, today's stay is a victory for him and his family, and also for due process and the fair administration of justice", Gregory Copeland, Supervising Attorney of the Immigration Law Unit at The Legal Aid Society, said in a statement. "I would feel guilty if something happened", one owner told the Post.
