According to Brooks, the production had a permit to shoot until 7pm outside the hotel, and until 10pm. inside.

Brooks alleges that in April 2017, when the film was shooting under the title "Labyrinth" in and around the Barclay Hotel in downtown LA, he informed the director Brad Furman that an upcoming take featuring Depp would have to be the last outdoor shot of the night because of legal permits. The lawsuit says Depp screamed obscenities at Brooks and punched him twice in the ribs, then offered him $100,000 to punch back. In the movie, Depp plays LAPD Detective Russell Poole, the honest officer who continued to investigate the killing years after its occurrence. Brooks said he was seeking out the off-duty sheriff's deputy serving as set security when Depp found him first.

Depp is then said to have punched Mr Brooks twice in the ribs.

"Throughout the altercation, Plaintiff noticed that Depp's breath reeked of alcohol", the suit reads.
