Cops search home of couple who raised funds for homeless man

On Aug. 30, New Jersey Superior Court Judge Paula Dow ordered the couple to return the remainder of the funds to Bobbitt's attorneys after Bobbitt requested a temporary restraining order that would bar the couple from spending any more of it. She didn't have money to repay him at the time, but sought him out days later to give him the money. Here's what's happening with this very sad, very 2018 story.

Mark D'Amico and Kate McClure gained viral fame when they started a fundraiser to pay back Johnny Bobbitt, a homeless man who gave $20 to Kate when her auto ran out of gas.

It was close to midnight and she was driving alone on I-95 when her vehicle ran out of gas as she was on an exit ramp. He then brought the gas can back to McClure's auto and filled the tank. "He walked up and he said, 'Get back in the auto". He told me to get back in the vehicle and lock the doors.

McClure couldn't believe what happened next. Both items have since been sold and the proceeds were provided to Bobbitt, they said. He even filled her auto up. But a day after the deadline passed, a lawyer for Bobbitt said there is no money left to surrender.

Mr Bobbitt has had past issues with drugs. McClure is a receptionist for the New Jersey Department of Transportation, and D'Amico is a carpenter, according to the Inquirer.

The couple said they used some of the funds to purchase Bobbitt a 1999 Ford truck and a travel trailer. They have denied the allegations.

And Bobbitt told the Inquirer that D'Amico gambled away some of the GoFundMe money at a casino in Philadelphia.

D'Amico said he controls the money and did nothing wrong.

"I don't think so", Dow said. Giving the money to someone addicted to drugs, he said, would be like "giving him a loaded gun".

Earlier this week, a lawyer representing Johnny Bobbitt said that all of the money raised through the page was gone.

GoFundMe announced Thursday that it will give a homeless man the $400,000 that authorities said a couple who raised it for him apparently kept for themselves.

McClure and D'Amico are expected to testify in court on Monday.

The filing also seeks compensatory damages and interest and counsel fees, and that a "guardian ad litem" be appointed for Bobbitt. Does the donated money belong to the person who set up the fund or the stated cause it's supposedly going to support?

After starting the fundraising campaign past year, Ms McClure said she did not have enough money to pay Mr Bobbitt back for $20 worth of fuel he bought her, but she returned to the spot where he begged in the days afterwards, giving him cash, clothing and food.

The judge who ordered them to turn over the remainder of the money said the couple must give those funds to their defense lawyer, who must then put it into an escrow account as the case continues, NBC Philadelphia reported.

Attorney Chris Fallon said he found this out during a conference call with the attorney for Kate McClure and Mark D'Amico on Tuesday morning.

Reached for comment Thursday morning, the couple's attorney, Ernest Badway, told CNN, "We have no comment".

The site raised more than $400,000 thousand dollars, which, according to the description for the fundraiser, was to be used to get Bobbitt an apartment and vehicle.
