Current U.S. immigration laws limit those who are likely to be dependent on financial aid.

The Trump administration announced a proposed rule Saturday that would make it harder for immigrants already in the US legally, as well as those seeking to enter, to obtain visas or green cards if they have ever been dependent on certain public benefits, like food stamps or public housing.

The rule would also make non-immigrants who receive or are likely to receive designated public benefits above the designated threshold generally ineligible for change of status and extension of stay.

The rule would primarily affect legal immigrants or people seeking to come to the USA legally, as undocumented immigrants are already ineligible for most means-tested public benefits.

Potentially disqualifying benefits include Medicare Part D prescription drugs, Medicaid with some exceptions for emergency services and disability services related to education, food stamps and Section 8 housing vouchers. The guideline specifically bars the authorities from considering such non-cash benefits in deciding a person's eligibility to immigrate to the United States or stay in the country.

The proposal will be subject to a 60-day comment period before coming into effect.

The administration estimated the regulations would affect about 382,000 people a year.

DHS said the changes contained in its 447-page proposal would primarily apply to those seeking admission to the United States or foreigners who attempt to apply for some form of residency status.

The regulation also would consider only the use of certain benefits by the individual applicant, and not their dependents, including USA citizen children.
