Republicans in Congress aren't cheering big win in Obamacare repeal lawsuit

The case, which was rendered in U.S. District Court in the Northern District of Texas, saw a Texas-led coalition of 19 states argue that the individual mandate in the Patient Protection and Affordable Care Act (ACA, also known as Obamacare) was unconstitutional following the passage of tax legislation a year ago.

"We're going to fight this tooth and nail - and the first thing we're going to do when we get back there in the Senate is put a vote on the floor, urging an intervention in the case", he continued.

This evening, as the Affordable Care Act's enrollment period ended, Judge Reed O'Connor of the U.S. District Court for Northern District of Texas issued his much-awaited opinion in Texas v. O'Connor agreed with Republican officials in 20 states who brought the case by calling the mandate "essential to and inseverable from" the entire law. When judging congressional intent, a judge must account for the amending Congress as well as the original Congress. "Pending the appeal process, the law remains in place", the White House said.

Senate Democratic leader Chuck Schumer tweeted that Republicans had pretended to care about those protected by Obamacare "while quietly trying to remove that support in the courts".

It's thought the case could go all the way to the U.S Supreme Court.

IN was one of 20 states involved in the lawsuit that challenged the constitutionality of the Affordable Care Act.

Trump tweeted Friday night that "Congress must pass a STRONG law that provides GREAT healthcare and protects pre-existing conditions".
